These Terms apply to all users of the Platform, including customers, vendors, advertisers, delivery partners, visitors, and any other parties interacting with Goldship.

Any violation may result in suspension or termination of your access.

Goldship serves as a marketplace connecting buyers and sellers.

While we strive to maintain accurate information, Goldship does not guarantee:

• Product availability.
• Product descriptions.
• Pricing accuracy.
• Vendor performance.
• Delivery timelines.

Products are offered by independent vendors who remain responsible for their listings and fulfillment obligations.

7. Orders and Transactions

When placing an order, you agree that:

• All information submitted is accurate.
• Payment authorization has been obtained.
• You intend to complete the transaction.

Goldship reserves the right to:

• Refuse or cancel orders.
• Limit quantities purchased.
• Verify payment information.
• Request additional information before processing orders.

All prices displayed on Goldship are subject to change without notice.

Customers are responsible for:

Payments must be completed using approved payment methods available on the Platform.

Failure to complete payment may result in cancellation of the order.

Delivery estimates should not be considered guaranteed delivery times.

Users are encouraged to review the Return Policy before making purchases.

Approval of returns is subject to eligibility requirements and applicable product conditions.

11. Vendor Responsibilities

Vendors using Goldship agree to:

Goldship reserves the right to suspend, restrict, or remove vendor accounts that violate platform standards.

• Promotional inserts.
• QR code campaigns.
• Branded delivery materials.
• Featured marketplace placements.

Advertisers are solely responsible for ensuring that promotional materials:

• Are lawful.
• Are accurate and not misleading.
• Do not infringe third-party rights.
• Comply with advertising standards and regulations.

Goldship reserves the right to reject or remove advertising content at its discretion.

13. Intellectual Property Rights

All content on the Platform, including:

• Logos
• Designs
• Graphics
• Text
• Images
• Software
• Website functionality

is owned by or licensed to Goldship and protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, modified, or exploited without prior written consent.

14. User-Generated Content

Where users submit reviews, comments, images, or other content, they grant Goldship a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display such content in connection with Platform operations.

Users remain responsible for the content they submit.

Goldship reserves the right to remove content that violates these Terms.

15. Limitation of Liability

To the fullest extent permitted by law, Goldship shall not be liable for:

• Indirect damages.
• Consequential losses.
• Loss of profits.
• Business interruption.

• Vendor misconduct.
• Delivery delays beyond reasonable control.

The Platform is provided on an "as available" basis without guarantees of uninterrupted operation.

16. Indemnification

You agree to defend, indemnify, and hold harmless Goldship, its directors, employees, affiliates, partners, and service providers from any claims, damages, liabilities, costs, or expenses arising from:

• Your use of the Platform.
• Violation of these Terms.
• Infringement of third-party rights.
• Misconduct or unlawful activities.

17. Suspension and Termination

Goldship may suspend, restrict, or terminate access to the Platform without prior notice if:

• These Terms are violated.
• Fraudulent activity is suspected.

Termination does not relieve users of obligations incurred before termination.

Continued use of the Platform constitutes acceptance of the revised Terms.

These Terms of Use shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the Kenyan courts.
